IEBC bosses to know fate as House tables sacking petition

Nine commissioners at the
Independent Electoral and
Boundaries Commission (IEBC) will
know their fate after National
Assembly Speaker Justin Muturi
formally introduced a petition
seeking their removal from office.
Mr Muturi directed the Justice and
Legal Affairs Committee to
scrutinise a petition filed by
Wafula Buke, seeking the removal
of IEBC chairman Isaack Hassan
and eight commissioners for “gross
violation of the Constitution and
incompetence in the way it
handled the March 2013 General
Election”.
He directed the committee, chaired
by Ainabkoi MP Samuel
Chepkonga, to scrutinise the
petition within the next 14 days
and file its report. The National
Assembly will then debate the
report and pass a resolution within
10 days of receipt.
Mr Buke used five MPs from the
Coalition for Reforms and
Democracy (Cord) – led by John
Mbadi (Suba) – to hand in the
petition to the Speaker shortly
before the House went on recess
in May.
In his petition, Mr Buke wants
Parliament to find that the
commission violated the
Constitution in the manner it
handled the disputed presidential
poll where President Uhuru
Kenyatta beat Cord leader Raila
Odinga.

ALLEGED INCOMPETENCE

Mr Odinga petitioned the election
at the Supreme Court and lost
after the court upheld the
declaration of Mr Kenyatta as the
winner of the presidential poll.
Other commissioners that Mr Buke
wants removed from office are
Lilian Mahiri Zaja (vice -
chairperson), Abdullahi Sharawe,
Thomas Letangule, Mohamed Alawi
Hussun, Albert Camus Onyango
Bwire, Kule Galma Godana, Yusuf
Nzibo and Muthoni Wangai.
Mr Muturi said Standing Order
number 225 requires the Speaker
to report on a petition brought
before Parliament other than that
filed by a member.
He said that the petitioner alleges
that the nine commissioners were
incompetent in the management of
the elections and wants them
removed pursuant to Article 251
(a) and (b) of the Constitution.
“He also prays that this House
recommends to the President to
form a tribunal for their removal.
I, therefore, direct the Justice and
Legal Affairs committee to
deliberate on the petition and file
its report on or before June 10,
2014,” Mr Muturi said.
While commenting on the petition,
Mr Mbadi clashed with Mr Duale
after the Majority Leader said
institutions should not be created
and disbanded according to
individuals’ whims.
